These Terms and Conditions of Use (“Terms of Use”) apply to the Victoria Pride Society (“VPS”) website: www.victoriapridesociety.org (“the site”). The Site is the property of the VPS. USE OF THIS SITE CONSTITUTES AGREEMENT WITH THESE TERMS OF USE. IF YOU DO NOT AGREE, DO NOT USE THE SITE.
The VPS reserves the right to add, remove, change, or modify part or all of these Terms of Use, at any time without notice. It is the responsibility of the person(s) (“the User”) visiting the website to check these Terms of Use for any changes. Continued use of the Site following any changes to the Terms of Use will constitute acceptance of the new Terms of Use. As long as you agree to the Terms of Use, the VPS grants you permission to enter and use the Site.
All text, graphics, interfaces, photographs, logos, sounds, music, video, and computer code (“content”) including (but not limited to) design, structure, expression, co-ordination, “look and feel”, and arrangement of the Content, is owned, or licensed by or to the VPS.
Unless otherwise stated by written permission from the VPS, or as stated in these Terms of Use, no part of the Site or content therein may be copied, duplicated, transmitted, translated, or otherwise redistributed in any way to any other computer, server, website, or other storage medium for any purpose.
The VPS grants you the right to print the List of Events page for the convenience of finding locations of listed events, and their start times. You may not save or transfer a copy of the List of Events page to any other storage medium unless otherwise stated by the VPS. The VPS also grants you the right to print and save any files specifically marked as downloadable.
Users may submit content in the form of Events Listings. The VPS is responsible for the wording of ONLY those events listed as “Official VPS Event” all other event descriptions are the responsibility of the person(s) or entity(ies) submitting the event for listing. The VPS reserves the right to modify the design of submitted content to fit with the over all “look and feel” of the site to ensure graphic and design continuity. The VPS reserves the right to remove any event from the listing at any time without notice.
The Site contains links that will take you to websites not associated with, or maintained by www.victoriapridesociety.org The VPS is NOT responsible for the content of those sites, and does not regularly examine linked sites for their accuracy, content, or online status. The VPS reserves the right to remove any link on the Site once it is determined that the link is no longer appropriate, or functioning.
The VPS may make available from time to time, downloadable forms for various reasons, including (but not limited to) parade registration, vendor registration, and information brochures (“downloaded items”). The VPS grants you the right to download and use the item for the purpose of which they were intended. You may not use the downloaded items for personal or monetary gain, or modify the downloaded items unless required to do so (limited ONLY to completing fields of a form).
The VPS may from time to time make some of its downloadable forms, and exclusive online forms available for online completion. The form submissions are handled by scripts provided for use by www.islandnet.com The VPS collects, and maintains all information on its online forms and does not sell, resale, or distribute any information to any other entity except as required by law. Please see our Privacy Policy to see how your information is collected and used.
Online payments and donations are handled by PayPal, and once directed to the PayPal site, the User is bound by the terms and conditions, and privacy policy of the PayPal site.
Refund of fees may be made at the sole discretion of the Board of Directors of the VPS, and will not include the refund of fees incurred by using PayPal. Certain events may not allow a refund of purchased tickets, and the VPS reserves the right to change which events are refundable at any time without notice.
Donations made to the VPS are not refundable, and no tax receipts will be issued.
The VPS newsletter is provided by Bravenet.com Signing up for the VPS newsletter will subject the subscriber to the Terms and Conditions, and Privacy Policy of Bravenet.com

You may not use any automated device, program, script, algorithm, or equivalent to copy, monitor, or in anyway reproduce any part or portion of the Site or Content. You may not attempt to gain unauthorized access to any portion of the Site that is not expressly linked, or otherwise accessible by means of authorized VPS redirection.
THE VPS DOES NOT HOST THE SITE ON ITS OWN SERVER AND DOES NOT GUARANTEE THAT THE SITE WILL BE ACCESSIBLE AT ALL TIMES. THE VPS DOES NOT PROMISE THAT FEATURES AND CONTENT OF THE SITE WILL BE ERROR-FREE, OR THAT SUCH ERRORS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE WILL PROVIDE SPECIFIC OR INTENDED RESULTS. THE SITE, ITS CONTENTS AND FEATURES ARE PROVIDED “AS-IS” AND ON AN “AS-AVAILABLE” BASIS. ALL INFORMATION INCLUDED IN THE SITE IS SUBJECT TO CHANGE WITHOUT NOTICE. THE VPS CANNOT ENSURE THAT ANY FILES OR OTHER DATA DOWNLOADED FROM THE SITE WILL BE FREE OF VIRUSES OR OTHER CONTAMINATED OR DESTRUCTIVE FEATURES. THE USER ASSUMES TOTAL LIABILITY AND RESPONSIBILITY FOR USING THE SITE. THE ONLY ACTION A USER MAY TAKE UPON BEING DISSATISFIED BY THE SITE IS TO STOP USING THE SITE.
The VPS reserves the right to do any or all of the following at any time without notice: (1) modify, suspend, delete, or terminate all or any portion of the Site (2) modify, suspend, delete, or terminate the Terms of Use and the Privacy Policy (3) to modify, suspend, delete, or terminate all or any portion of the Site to perform routine maintenance, error correction, additions, or other changes.
The VPS may disclose any information it has collected through the site if it is required to do so by law (including but not limited to presentation of warrant or court order). Should the VPS disclose personal information, the VPS will attempt to notify the affected party(ies) unless the VPS is legally required to refrain from doing so.
If the VPS determines that you have violated the Terms of Use, you agree that the VPS may terminate your use of the Site with no prior notice. Any violation by you of these Terms of Use may result in legal action, and you agree that the VPS may seek to recover monetary damages (including but not limited to legal fees, and other associated costs). You agree that the VPS will not be liable to you or any other party for termination of your access to the Site as a result of the violation of these Terms of Use.
You agree that all matters relating to your access to or use of the Site, including all complaints, and disputes will be governed by the laws of Canada, by the laws of the Province of British Columbia, and the bylaws of the City of Victoria.
Any dispute you have with the VPS regarding the use of the site must be brought to the attention of a Board Member within thirty (30) days of the disputed action taking place. Any dispute brought to the VPS after thirty (30) days of the disputed action taking place, will be considered “in the past” and unless otherwise stated in writing by the Board of Directors of the VPS, will not be dealt with, shall be considered resolved, and you further agree to absolve the VPS of all responsibility related to the disputed action. If the dispute cannot be resolved by the VPS Board and the affected party(ies) then either party may submit the dispute to mediation. Should mediation not be able to resolve the dispute within sixty (60) days of the start of mediation, then either party shall be free to pursue any action available to them under applicable law.
The VPS administers the www.victoriapridesociety.org Site from its location in Victoria BC Canada. The site is available worldwide, however, not all features, or events discussed are available outside their stated locations. If you choose to access the Site from outside Canada, you do so at your own risk and initiative, and are solely responsible for complying with local laws.
